By accessing or using Kiru ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

Kiru is operated by Dreams of LLC ("we", "us", or "our"). These Terms govern your use of the Kiru desktop application and related services.

2. Description of Service

Kiru is a video editing application that provides transcription-driven editing tools, including:

  • AI-powered video transcription
  • Bad take and false start detection
  • Silence detection and removal
  • Export to various formats including MP4 and DaVinci Resolve

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

4. Subscription and Payments

Kiru offers both free and paid subscription plans. By subscribing to a paid plan:

  • You authorize us to charge your payment method on a recurring basis
  • Subscription fees are billed in advance on a monthly or annual basis
  • You may cancel your subscription at any time through your account settings
  • Refunds are provided in accordance with our refund policy

We reserve the right to modify pricing with 30 days' notice to existing subscribers.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Upload content that infringes on intellectual property rights
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or servers
  • Share your account credentials with others
  • Use the Service to process content that is illegal, harmful, or violates third-party rights

6. Intellectual Property

The Service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you upload to the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising out of your use of the Service or violation of these Terms.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
